Laws current as of December 28, 2023 Step 5. Trial
After the parties finish with exchanging information (“discovery”), the case will go to trial unless a settlement is reached. If you go to trial, both sides will present evidence and argue for what they want. The judge will then decide what s/he thinks is fair and then issue a divorce decree containing his/her orders.
