Laws current as of November 6, 2024 When a child is born to unmarried parents, who has custody?
Under Arkansas law, if the parents have never been married and there is no custody order, the mother of the child has legal custody by law.1 For a father to get custody rights, first he would have to establish paternity. Then, he would have to file in court and a judge would have to grant him custody.2
