What is the legal definition of a sexual assault offense?
For the purpose of getting a sexual assault protection order, a “sexual assault offense” means committing or attempting to commit any of the following:
- sexual assault in the 1st degree, 2nd degree, or 3rd degree;
- sexual abuse by a school employee;
- sexual assault of a child in the 1st degree, 2nd degree, or 3rd degree;
- unlawful intrusion, recording image or video of an intimate area, or distributing or making these images public; or
- “sexual contact” or “sexual penetration” without consent.1
