76-12-308. Distribution of images obtained through voyeurism

(1)(a) As used in this section, “image” includes print, electronic, magnetic, or digital format.

(b) Terms defined in Sections 76-1-101.5, 76-12-101, and 76-12-301 apply to this section.

(2) An actor commits distribution of images obtained through voyeurism if the actor distributes or sells an image obtained by conduct in violation of Section 76-12-207, Recorded or photographed voyeurism, by transmission, display, or dissemination.

(3)(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is a third degree felony.

(b) A violation of Subsection (2) is a second degree felony if the image is of a child under 14 years old.
