Who can get a stalking injunction?

Any person who believes s/he is a victim of stalking may file a petition for a stalking injunction at the district court. You can get a stalking injunction against anyone who is stalking you, regardless of your relationship to that person.1 The only exceptions are if the stalker is a:

  1. law enforcement officer, governmental investigator, or licensed private investigator acting officially and for a legitimate purpose; or
  2. business owner acting in a reasonable way to protect his/her business. However, this exception doesn’t apply if it’s the business owner’s cohabitant who is requesting an injunction.2
