What are the legal definitions of abuse and dating violence in Utah?
For the purposes of getting a dating violence protective order, you must have experienced “dating violence” or “abuse” by a dating partner, or there must be a significant chance (substantial likelihood) that you will experience either one.1
Abuse by a dating partner is defined as:
- causing or attempting to cause you physical harm; or
- placing you in reasonable fear of immediate physical harm.2
Dating violence is defined as when a dating partner does any of the following against you:
- commits or tries to commit (attempts) a crime involving violence or physical harm;
- makes a threat of violence or physical harm;
- asks (solicits) someone else to commit a crime involving violence or physical harm; or
- makes a plan (conspires) to commit a crime involving violence or physical harm.3
