If my grandchildren are adopted within the family, can I still get visits with them?
If your grandchildren are adopted, you can only get or continue having visitation rights if:
- they are adopted by a stepparent or another relative like a grandparent, great-grandparent, sibling, half-sibling, aunt, great-aunt, uncle, or great-uncle; and
- the judge believes it is in the children’s best interests to have visits with you.1
If your grandchildren are adopted by their stepparent, and the adoptive stepparent’s spouse objects to your visits, the judge would consider the factors listed in What factors will a judge consider when deciding if a grandparent can get visitation? to decide whether or not you can still have the visits.2
Note: If your grandchildren are part of an adoption proceeding, you will file your visitation petition in probate court, not circuit court.3
